• Fraudulent, collusive, or suspicious activity is detected.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, no4jl, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL DAMAGES, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN NO EVENT SHALL no4jl'S TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU HAVE DEPOSITED INTO YOUR ACCOUNT DURING THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

9.3 Force Majeure

no4jl shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, government actions, telecommunications failures, internet service disruptions, power outages, or equipment failures.

10. Dispute Resolution

10.3 Arbitration Agreement

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or validity thereof, that cannot be resolved through Customer Support shall be settled by binding arbitration administered in accordance with Philippine arbitration rules. The arbitration shall be conducted in English, and the seat of arbitration shall be Manila, Philippines.

YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS PART OF A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS OR CLASS ARBITRATIONS.

10.4 Exceptions to Arbitration

Notwithstanding the arbitration agreement above, either party may bring an action in a court of competent jurisdiction seeking injunctive or other equitable relief in cases involving intellectual property infringement, fraud, or violations of these Terms that cause irreparable harm.

11. Amendments to Terms

Your account balance (minus any disputed funds or pending bonuses) will be returned to you in accordance with our withdrawal procedures.
